Court Date Set In Joey Aguilar Lawsuit Against NCAA
A court date has been set to hear arguments for a preliminary injunction regarding a lawsuit brought by several college football players against the NCAA. The suit was first filed by Vanderbilt quarterback Diego Pavia and now several other athletes have joined the lawsuit including Tennessee Vols quarterback for 2025, Joey Aguilar. The suit seeks to have a court overturn a rule by the NCAA that counts junior college time towards Division I eligibility years.
For instance, in Joey Aguilar’s case, he spent two years playing at a junior college before transferring to Appalachian State where he played for two seasons, before then coming to Tennessee last season. Under the current NCAA rules, Aguilar is no longer eligible to play in the NCAA, because the two years at a junior college are being counted towards his five years of NCAA eligibility. The lawsuit seeks to have junior college time not count towards Division I years.
Aguilar and others are seeking a preliminary injunction to allow them to play the 2026 season while the lawsuit is making its way through the court system. The time and date for the preliminary inunction hearing is set for Feb. 10 at 1pm in Nashville. The ruling in that hearing will have effects on Tennessee’s 2026 season, as a favorable ruling would see Aguilar back for a second season under center on Rocky Top.
